1. OBJECT AND GENERALITIES

The present Conditions of use, together with other particular conditions that may be established, have the object of the Website http://www.edunkates.com (hereinafter referred to as “Website”), as well as the conditions of purchase of products through it.

The website is owned by Moldacampo - Molds for Plastic Injection, Unipessoal Lda, with Portuguese TIN number 507580400, with registered office at Rua de Santo António Nº 821 Armazém G, 4475-611, Maia, Portugal. (here in after referred to as “Edu&Kate's”).

The use of the Website services, as well as the purchase of any of the products offered, presupposes the acceptance of the Client or User, without reservations of any kind, of these Conditions. The registration on the Website and the use of the services assume that your data as a User will become part of Edu&Kate's files and their treatment will be in accordance with the privacy policy that the User expressly declares to know and accept.

Edu&Kate's provides information about the products and offers the possibility to purchase them through the Website. People wishing to purchase products must complete the respective registration form before the purchase process and follow the steps that Edu&Kate's will indicate through the website.

These Conditions, together with the Website's Privacy Policy, are the only conditions applicable to the use of the Website and the purchase of products through it and replace any other conditions. Consequently, the User who accesses the Website, who registers and purchases products through the Website agrees to submit and remains bound by the Conditions and the Privacy Policy, as they are written when accessing the Website.

Any user who registers on our website must be at least eighteen (18) years old.

2. INTELLECTUAL AND INDUSTRIAL PROPERTY

The contents of the website, including texts, images, graphics, illustrations, characters, photographs and any other elements susceptible to industrial and commercial use are the property of Edu&Kate's or the respective brands marketed by the website, their use by third parties is not allowed.

Of all the content materials owned by brands or others, we have the due declaration of the owners of the same that duly authorized their inclusion on the website and are protected by national and international legislation on intellectual and industrial property.

In no event will it be understood that Edu&Kate's grants any license relating to the waiver, transfer, total or partial assignment of said rights, nor does any right of alteration, exploitation, reproduction, distribution or public communication be granted on these contents without the prior written authorization of the owner. The User can only use the website and its contents for consultation and personal and private use.

3. PRODUCT INFORMATION

Photographs, graphic/iconographic representations and videos related to Edu&Kate's products, as well as the commercial names, brands or distinctive symbols of any kind contained on the website, aim to provide maximum information. However, the user must take into account that these have an indicative purpose and, therefore, lack an exhaustive character.

Edu&Kate's reserves the right to decide, at all times, which products are available to users through the website. In this way, Edu&Kate's may at any time add new products to those present on the website, it is understood, unless otherwise specified, that such new products will be subject to the provisions of the conditions that are in force at that time.

In addition, Edu&Kate's reserves the right to stop facilitating access, at any time and without prior notice, to any of the products available on the Website.

In the event that, due to unforeseen circumstances, a product is not available after making the purchase, Edu&Kate's will inform the customer, by email, of the total or, as the case may be, partial cancellation of the order. The partial cancellation of the order does not give the right to cancel the entire order, without prejudice to the exercise of the right of withdrawal available to the customer, in accordance with the provisions of these Conditions.

4. PURCHASE SYSTEM

To proceed with the purchase of the product, the User must select the product he wishes to purchase and add it to the Cart. As soon as the product selection is complete, the User must click on the “Checkout” icon. Then, the products selected for purchase will be indicated and the User must select one of the available options for sending the products to the indicated address, as well as the payment method. Finally, the user must click on the “Complete the order” icon.

The data provided to Edu&Kate's through the respective form are identifying and enabling elements for accessing and making purchases and are personal and non-transferable.

5. DELIVERY TIME

Shipments to Portugal take approximately 2 to 5 working days (Monday to Friday), counting from the confirmation of payment by the customer. As soon as the order is delivered to the courier services, the Customer will receive an email with the order tracking number. We are not responsible for possible delivery delays caused by courier services.

In case the user currently receives the order in poor condition, he will have to sign with reservation (for example, indicating the packaging flaws).

6. PAYMENT METHODS

Payment methods accepted by Edu&Kate's are:

• CREDIT/DEBIT CARD:

The Customer will be redirected to the Paypal page, taking advantage of its secure payment platform. After payment is made, you will beredirected back to Edu & Kate's. Once you are on the Paypal page, you can pay with your Paypal account or credit card. Under no circumstanceswill payment be accepted upon collection.

Paypal may withhold an amount as a guarantee or insurance when you try to make a purchase with your card on the PayPal platform (this is usually a few cents or $1). This amount will be refunded by PayPal within a month or so. The collection of this amount does not guarantee that the purchase will go through.

• PAYMENT REFERENCE:

When selecting this payment option, you will subsequently receive an email with the ATM reference to proceed with the payment. Aftersending the email you have up to 72 hours to make the payment or the order will be automatically cancelled.

8. SHIPPING INFORMATION

• Orders are shipped via CTT and TNT.
• Shipping costs include, in all cases, Value Added Tax (VAT), but no other taxes, fees, customs taxes or surcharges.
• Shipping is understood to mean delivery of the items to the home or address specifi ed by the customer during the order fulfi lment process, limited to the delivery zones mentioned above.
• Edu&Kate's delivers orders to CTT's and TNT services within a maximum of 24 hours. We are not responsible for possible delivery delayscaused by postal services.
  
  

9. RETURNS

If the Customer changes his opinion or if he is not satisfi ed with its purchase, it can be returned within 14 consecutive days from the date ofreceipt. For this, we only ask you to notify us in writing via email CustomerService@edunkates.com, indicating the necessary data to identify thepurchase. On our part, as soon as we receive your email, we will acknowledge your receipt, indicating the procedure to follow. You must sendus the products in perfect condition, at the latest within 14 consecutive days after receiving the email. In these cases, Edu&Kate's will reimburse the customer for all costs of the original purchase. However, the customer will assume the direct expense of returning the products.

Once the order is marked as payment received & shipped we won't be able to cancel it.

10. WARRANTY

All of our products have a two (2) year warranty when the damage or defect is attributable to us. Therefore, if the product is defective, Edu&Kate's will take care to collect the product and exchange it for the correct one, assuming the costs associated with this return andexchange (except for the additional costs resulting from the choice of an urgent delivery method , in which case, the Customer must bear this extra cost). In order to manage the occurrence, we need you to notify us by email via customerservice@edunkates.com, indicating the reason for the occurrence, the order number (essential to identify the purchase), the delivery note of the purchase and photos of the product damagedor wrong, so that we can assess the situation. To exercise the guarantee right, you must have proof of purchase or delivery note.

As soon as we receive this information, we will contact the Customer to explain the steps to follow. You must inform us of the non-conformity of the product within two (2) months from the day you become aware of the defect. In the event that it is not objectively possible to replace theproduct with another in the same category, Edu&Kate's will proceed to refund the value of the same.

It is important to know that our warranty does not cover:
a) negligent or violent use of the product.
b) the damages resulting from the manipulation or modification of the product.

Besides that, it is also important that you always follow any instructions for using the products we provide you and, in case of doubt, youshould contact us by e-mail through suporteaocliente@edunkates.com to receive advice on the use of the product.

11. TAXES

Prices include, in all cases, Value Added Tax (VAT), but no other taxes, fees, customs taxes or surcharges.

12. PRICES

The products will be sold at the indicated price, with what is presented when the customer confi rms the order in force.

13. SHELF LIFE

Edu&Kate's reserves the right to modify prices, articles, offers and other commercial conditions without prior notice.

14. MODIFICATION OF CONDITIONS

Edu&Kate's reserves the right to revise and modify these Conditions at any time. The User will be subject to the policies and Conditions in forceat the time he uses the page or makes each order, unless, by law or by decision of government agencies, Edu&Kate's has to make changesretroactively in such conditions, and in this case in this case, the possible changes will also affect the requests that the user has previouslymade.

The client undertakes to use this page only to make legally valid inquiries or requests and not to make any false or fraudulent requests.Otherwise, we are authorized to cancel it and inform the competent authorities.

The User must not carry out any prohibited use of this page, being understood as such, among other cases, the intentional introduction ofviruses, Trojans or any other technologically harmful material.

We will not be responsible for any other damage or loss that affects your computer as a result of the above actions, or the use of this Internetpage or the download of its contents or to which it redirects.

17. LINKS TO OTHER PAGES

Our page may contain links to other Internet pages, social networks or third party materials. These links are provided for information purposes only and Edu&Kate's has no control over the contents of such Internet pages or materials. Consequently, Edu&Kate's will not be liable in anyway for damages or losses arising from the use of such third party links or materials.

18. RESPONSIBILITY

Edu&Kate's is not responsible for delays in the delivery of orders or, in the impossibility of fulfi lling them, when the cause is due to events offorce majeure and, therefore, beyond our control. Among other reasons, we understand that there is force majeure in the following cases, butnot limited to: accidents; strikes; revolts, threats or terrorist attacks; fi re or explosion; meteorological causes or natural disasters, such as storm,fl ood, earthquake, collapse, epidemic; problems unrelated to us in means of transport or telecommunication systems. As far as possible, oncethe cause of the impossibility or delay has ended, Edu&Kate's will do everything possible to resume its commercial activities and be able to fulfill its obligations and shipments.
